Worldwide Legal Issues with Google, Twitter, Facebook, YouTube et al

Individual countries all over the world are challenging what I call "The Masters of the Universe" on legal grounds, taxation, violations of privacy and unfair business practices.

The entire EU, France individually, the US federal government individually, and now individual states within the US are challenging the social media conglomerates on various issues.

The above general issues are what this thread is about -- not your individual phone or computer problems. The laws in all countries are different, so that should be taken under consideration before assuming that every government body in the world operates the same way. They don't.

Now it looks like there is conflict between two of the technology giants -- Apple and Google.

Google has recently claimed that there are security flaws in the iOS Apple phones. This despite Apple releasing patches to fix the flaws.

Apple has released a statement through their web site:
“Google’s post, issued six months after iOS patches were released, creates the false impression of ‘mass exploitation’ to ‘monitor the private activities of entire populations in real time,’ stoking fear among all iPhone users that their devices had been compromised,” said Apple in the statement.

“This was never the case.”
A further contention by Apple is that the attacks were operational for a brief period of two month, not the two years that Google claims.

Apple says the vulnerable iOS was fixed within 10 days after learning of it.

It was inevitable that they would start going after each other.

Reuters is reporting that Facebook is under more legal scrutiny.

US District Judge Vince Chhabria in San Francisco has ordered Facebook to be subjected to a nationwide lawsuit seeking damages for allowing third parties to access the private data of users.

Facebook may be held liable under numerous state and federal laws for illegal harvesting of data without consent.

During hearings, Facebook claimed that users suffered no "tangible harm" and had no right to privacy that they were already sharing on social media. In the same breath, a Facebook spox stated that they consider protecting users information and privacy “extremely important." Huh? Can't be both.

Judge Chhabria noted that Facebook has contradicted itself. Their arguments in other cases (one in California), where Facebook described their social media accounts as similar to data stored on smartphones with a higher expectation of privacy, are different than what Facebook is claiming now.

Ooooops.

The judge stated that "sharing information with your social media friends does not categorically eliminate your privacy interest in that information.”

Now Facebook and Apple are going at it.

Forbes is reporting that Facebook is telling users that things work better if users enable real-time location tracking. Facebook warns that Apple and Android devices may prevent the platform from tracking you.

I would think that's a GOOD thing.

In other words, the upgrades to smartphone operating systems has a lockdown feature. The smartphone user now has the power and ability to control when their location is shared. Facebook is unhappy because they have a long history of abusing user privacy and sharing/selling personal information.

Apple's new iOS 13 has an "allow once" feature that requires the user to grant permission each time tracking is allowed.

Bipartisan effort by state attorneys general launching Google antitrust investigation.

Over a dozen state attorneys general -- both Democrat and Republican -- have begun an investigation into Google that will involve almost every state in the United States (minus California and Alabama). The specific focus of the investigation is Google's dominant control of online search markets/traffic that stifles competition, restricts access and harms consumers.

Eleven other attorneys general have also started a similar investigation into Facebook. That investigation is focusing on violations of competition laws and abuse of citizen privacy.

It is highly unlikely that Google is going to engineer Android to ever stop tracking, though it may allow users to prevent other apps from accessing this information.

Apple and the EU in court

Apple is challenging the EU's $14 billion tax payable to Ireland. The EU claims that Apple received illegal tax benefits over almost 20 years. Both Ireland and Apple have appealed the order. Ireland disputes the EU’s interpretation of Irish tax law.

The EU court has denied US officials to intervene in the tax challenge.

Facebook contradicts themselves. Who is surprised?

Congressional candidate Laura Loomer filed suit against Facebook for defamation when it labeled her as a "dangerous individual" to justify banning her account.

In the past, FB has claimed to be a "platform," not a publisher. This designation coming straight from Zuckerberg in previous congressional testimony.

In US law, there is a legal distinction between a "publisher" and a "platform." The Communications Decency Act (section 230) provides that tech platforms have immunity from lawsuits arising out of their decisions to host (or not to to host) user-generated content. Publishers, however, are liable if their writers defame someone. Platforms are not liable. These distinctions are central to legal protections involving big tech companies.

So now, as a matter of convenience, FB has filed paperwork in the lawsuit that now claims the distinction of "publisher."

FB is now saying that it has a 1st Amendment right as a "publisher" not to accept Loomer's content. There are volumes of legal precedent that removes liability from "publishers" for failing to publish someone else's content.

FB is calling on the court to dismiss Loomer's case.

The US and UK have made a deal to access data from tech companies related to criminal investigations. This will allow the UK to go directly to companies like Facebook, Google or Twitter for electronic evidence.

As long as no one is making up things, this should be worthwhile.

Questions arising over a new Facebook app.

The private messaging app "Threads" for Facebook now requests 24/7 access to just about everything on your phone.

Supposedly targeted for just the user's "closest friends," you won't be able to use it unless you give Facebook access to just about everything about you.

Access is required to the following:
- Continuous location access
- All movement and fitness activity
- Battery level
- Connection type
- Closest friends

Despite Facebook's attempt to "rebrand" itself as being concerned about your privacy, they continue to lie.

Australia, the US and Britain have combined their resources to request that Facebook suspend their efforts to encrypt their messaging systems due to the negative effects it will have on their efforts against child exploitation and terrorism.

Ireland investigations into Facebook and Twitter have concluded.

The investigations centered around possible breaches in EU data privacy rules.

In the next phase, Ireland will determine the penalty for breaching those rules, which could be a fine of up to 4% of their global annual revenues. In the case of Facebook, they'd be looking at a fine of more than $2 billion.

These investigations have become routine in Ireland because many of the Masters of the Universe have their EU HQs in Ireland. Over a dozen investigations have been opened into Facebook, Apple, Google and Twitter.

EU fascism in all its glory fighting against the Masters of the Universe.

The EU's "Court of Justice" handed down a ruling last week that members of the EU can order Facebook to take down insulting content WORLDWIDE. This ruling centered around the Austrian Greens Party politician, Eva Glawischnig-Piesczek. She was referred to as a “lousy traitor of the people” and a “corrupt oaf”, among other things.

Eva G-P demanded that Facebook Ireland remove the news article. She also secured a court order commanding it when Facebook refused to comply. Instead, Facebook only restricted the content in Austria.

The EU Court now requires GLOBAL compliance with censorship orders.

All parties involved in this are violating free speech.

The EU has questions about Facebook's digital currency "Libra."

The EU has not only had antitrust questions about the currency, but the new scrutiny is related to financial stability, money laundering and data privacy risks.

As is usually done, Facebook is going a lot of bobbing and weaving.

France has already announced plans to block development of the currency as a threat to currency sovereignty. There are also concerns throughout the EU that privacy will be at risk.

PayPal has already withdrawn from recognizing Libra on its platform.

The Libra Association continues to claim that over a thousand "entities" are interested in participating in their project.
