Houses on Nor Sor 3 Gor land

Looking at some NS3 Gor land and measured the length at 75m. Beyond that there were some small wooden houses/huts. That was fine, 75m would be fine for us.

However, when looking at the actual Land Dept plan of the plot it shows the length as 91m...ie it would appear that the wooden houses/huts have been built at some point in the past on NS3 Gor land (which has been used for sugar cane).

We are going to remeasure, but assuming this is the case, and also that we would call in the Land Department to confirm, what would be the situation about removing these unauthorised dwellings so we could enjoy the whole plot?

It could be important because upon removal there would be access to a second road for an entrance (as we plan to build two houses on them) rather than a shared drive.

You might be asked to fund the re-survey of the land , before any govt department makes recommendations ????

It may be that the owners of the two other buildings make a 'claim' for the ownership of the land on which they have built. If the plot is Nor Sor 3 Gor, such a claim would probably hold up any transfer to 'Chanote'. My wife had this problem - (we solved it by buying them off) except one guy and in order to obtain a 'chanote' for our land we had to let this one guy keep the bit his house was on.

I suggest that you consult the land office first and then a lawyer.

Update.....the land was confirmed at 91m, and so has two houses on it...not a big problem - the main one is empty and the 'owner' is living away with children. Other one...well maybe we can live with it.
NOw...a further question. One section of the land (about 15m x 3 meters wie has been used by an adjacent 'land owen' to grow more sugar cane. Whilst I appreciate the people with houses have possessory rights I do not believe this would appy to someone who has simply used the land to grow crops.
Anyone like to comment? My own instinct would be to bulldoze through that section and let him try and take us to court......

Get ur lawyer to write a nice eviction notice. AFTER the sugar cane has been cut.

That way your houses might still be there.

Having made comments about the past I now find myself in a present situation as follows. My wife owns a small piece of land (less than one rai) on a Nor Sor 3 Gor paper. About a week ago, a developer bulldozed a three meter strip down one side and said that this was his access road to a new four house development.

We went to the land office with my wife's Nor Sor 3 Gor paper. First officer said no problem could be changed into 'chanote' in 21 days. We pointed out that construction was under way, which received a shrug. Filled in various forms paid a small fee and were told that Govt surveyors would be at the plot on the 22nd Jan to show the exact dimensions of the land and place marker stones. My wife has since received written confirmation of this, and we know that at least one adjacent land owner has received notification from the land office to attend the surveyors should they wish.
Hopefully this will resolve the issue with the developer

Adverse possession, might still apply under Thai Law ?

Land Office would rule on that .... once the survey has been completed and lodged, maybe there is a period after its lodged that the affected owners have to leave the land / property.

Maybe the farmers who have crops on this affected area are entitled to compensation for the crop thats about to be lost or destroyed. Land Office / lawyer would know

Update: As mentioned earlier, the Land Office surveyors came today with four numbered cement cores which they dug in to the corners of our property. Everyone present had to sign to say that they had seen and agreed to this.

This demonstrated clearly to the developer that he was encroaching on our land. However, the land office officials said that this was none of their business, and my wife has to sort it out with the developer. They (unofficially) advised my wife to build a wall enclosing her land - the developer would then have to knock it down to gain access.

My wife was told that she could expect the new land registry paper (Chanote) within two weeks.
