Law and ethics are two entirely different things.
Trump cynically sets up companies at arms length to his personal finances. If things go well, he profits, if things go badly, he burns the company leaving creditors unpaid, these are quite often small businesses. So many thousands of businesses never get paid. All very legal in the USA, it would likely not be legal in Australia as Phoenix legislation has shut down this type of structures for serial offenders.
As a result many building companies will no longer deal with Trump, so he has changed tactics. He licenses his 'Trump' name to third parties, but has no financial interest in developments that may use the Trump name.
However, it is not ethical by any standards. People might call it smart, others would call it cynical.
